Terms of Service

Viewing gallery/credits:

An online viewing gallery will be available within 1 month of the photo session. When this occurs, Client will be notified by Contractor. This viewing gallery will be available for 30 days and Client must download the photos during that period.

Release of digital negatives:

Contractor authorizes Client to use the images contained in the online gallery for personal use only. As such, Client may download and store the images, make prints for personal use and display images on personal or social networking websites/apps. The images may not be sold for profit or published without the prior written consent of Contractor. Once the images have been released to Client via the online gallery (for 30 days), Contractor shall be released of all liability for future archiving of those images. Should Client ever lose their images and wish to purchase those still in the possession of Contractor, those collective images can be re-sold for the same price as the initial session fee established within this Agreement.

Editing: 

Contractor will not include original photographs in the online gallery; only edited photographs will be provided. Client agrees to maintain and preserve Contractor’s editing and style. The photos must only be used, printed, or otherwise depicted, displayed, or shown as is, without additional edits or alterations, unless express permission is given by Contractor. Any unauthorized alteration of images will be deemed a violation of copyright.

Copyrights:

Contractor will retain the exclusive copyright ownership of all images taken and produced as a result of this Agreement. The photographs produced by Contractor are protected by Federal Copyright Law (all rights reserved) and may not be reproduced in any manner without Contractor’s written consent. Written consent for reproduction and display rights may be provided by Contractor to Client upon request.

Exhibition: 

Client grants Contractor permission to use Client’s image or likeness, and to display or publish any images resulting from this Agreement as an example of the Contractor’s work for purposes of marketing, advertising, use on social media or company websites, and for entrance into competitions. Client releases all claims to profits that may arise from such activities.
